FAQ

Answers to the Questions Arizona Families Ask Most

Direct, plain-language answers from Nicole on the issues that come up at almost every consultation.

Do I need a will or a trust?+

Most Arizona adults benefit from at least a will, durable powers of attorney, and health care directives. A revocable living trust becomes especially valuable when you own real estate, want to keep your affairs private, or want your family to avoid probate. During our consultation, Nicole walks through your specific situation and recommends the structure that actually fits your life rather than defaulting to the most expensive option.

What happens if I die without an estate plan in Arizona?+

Arizona's intestate succession laws decide who receives your property, and the probate court oversees the process. That can mean delays, public filings, court costs, and outcomes that do not reflect your wishes. Blended families, unmarried partners, and small business owners are usually hit hardest. A simple plan put in place now prevents almost all of these problems.

How does the virtual process work?+

After a brief fee review and a guided intake worksheet, you meet with Nicole over video from anywhere in Arizona. She drafts your documents, sends them along with a personalized explanatory video, and answers your questions. The only in-person step is the final signing at the Phoenix office, where we notarize and witness everything to make it valid under Arizona law.

How long does an estate plan take to complete?+

Most clients move from intake to signed documents in two to four weeks. We can move faster when circumstances require it, such as an upcoming surgery or travel. The pace is yours; Nicole keeps the process moving without rushing important decisions.

What is probate and how can I avoid it?+

Probate is the Arizona court process for transferring assets after death when there is no trust or other transfer mechanism in place. It is public, takes time, and costs money. A funded revocable living trust is the most common way Arizonans avoid probate. Beneficiary designations, payable-on-death accounts, and properly titled property also help.

Do I need a lawyer to form an LLC in Arizona?+

You can technically file Articles of Organization yourself, but the operating agreement is where the real protection lives. A well-drafted operating agreement prevents disputes between owners, clarifies what happens when someone leaves or dies, and helps preserve your liability shield. We routinely help small Arizona businesses with formation done right the first time.

What is a durable power of attorney and why do I need one?+

A durable financial power of attorney lets a trusted person manage your finances if you become incapacitated. Without one, your family may have to petition the court for conservatorship, which is slow, public, and expensive. The document is inexpensive, easy to put in place, and protects your loved ones from a worst-case scenario.

How much does estate planning cost?+

Our Will Package starts at $1,350 for individuals and $1,600 for couples. Our Trust Package starts at $2,500 for individuals and $3,000 for couples. A la carte documents range from $350 to $1,800. We honor a $150 discount for booking directly and 15% off for educators, military, and first responders. Visit our pricing page for full details.

Can you help same-sex couples and domestic partners?+

Absolutely. Estate planning matters even more for couples whose relationships may not be automatically recognized in every legal context. We draft domestic partnership agreements and full estate plans tailored to protect each partner and their wishes, whether married or not.

What areas of Arizona do you serve?+

All of Arizona. Our office is in Phoenix at 706 E. Bell Rd, but the firm is virtual-first, so clients work with us comfortably from Tucson, Flagstaff, Prescott, Sedona, Yuma, and every community in between. The only in-person requirement is the signing appointment in Phoenix.

Do you handle probate when a loved one passes?+

Yes. We guide families through informal and formal probate, trust administration, and the court filings that come with settling an estate. Our role is to handle the legal mechanics with care so the family can focus on each other.

What should I bring to my consultation?+

Bring a list of your assets (real estate, accounts, business interests, life insurance), the people you would like to involve in your plan (spouse, children, trusted friends), and any existing estate documents. Nicole will guide you from there.
